1. Acceptance of Terms
By accessing or using AskTuring’s platform, services, or website (collectively, the “Service”), you agree to be bound by these Terms and Conditions (“Terms”). If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Description of Service
AskTuring provides an AI-powered document intelligence platform that allows users to:
- Create private, searchable indexes from uploaded documents
- Query documents using natural language through AI models
- Collaborate with team members on shared knowledge bases
- Access multiple AI models (including Claude, ChatGPT, and Gemini) through a single interface
- Maintain complete data privacy with zero AI training on customer data
Account Creation: You must provide accurate, complete information when creating your account and maintain its accuracy.
Account Security: You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activities occurring under your account
- Immediately notifying us of any unauthorized access
- Using strong passwords and enabling available security features
4. Data Privacy and Security
Zero Training Commitment: AskTuring will never use your uploaded documents, queries, or conversations to train any AI models, whether our own or third-party models.
Data Isolation: Your documents and indexes are stored in isolated, private instances with enterprise-grade encryption at rest and in transit.
Third-Party Models: When you use external AI models through our platform, your interactions are subject to both these Terms and the respective model provider’s terms. We facilitate secure communication but do not control third-party model providers’ data practices.
Data Retention: You retain full ownership of all content you upload. We will delete your data upon account termination as specified in our Privacy Policy.
5. Acceptable Use
You agree not to:
- Upload content that violates intellectual property rights, privacy rights, or applicable laws
- Use the Service for illegal activities or to generate harmful, discriminatory, or malicious content
- Attempt to reverse engineer, hack, or compromise the security of our Service
- Share account credentials or attempt to create unauthorized accounts
- Upload malware, viruses, or other malicious code
- Interfere with or disrupt the integrity or performance of the Service
Your Content: You retain ownership of all documents and data you upload. By using the Service, you grant us a limited license to process, store, and analyze your content solely to provide the Service.
Our Technology: All software, algorithms, interfaces, and technology underlying the Service are proprietary to AskTuring and protected by intellectual property laws, including our patented Semantic Mapping technology.
Generated Content: Content generated through AI interactions using your documents remains subject to your ownership of the underlying source materials.
7. Service Availability and Performance
Uptime: While we strive for high availability, we do not guarantee uninterrupted service and may perform maintenance that temporarily affects access.
Model Availability: Third-party AI model availability depends on external providers and may be subject to their terms, pricing changes, or service interruptions.
Feature Updates: We may modify, update, or discontinue features with reasonable notice to users.
8. Subscription and Billing
Payment Terms: Subscription fees are billed in advance according to your selected plan and are non-refundable except as required by law.
Price Changes: We may change subscription prices with 30 days’ notice to existing subscribers.
Suspension: We may suspend Service access for non-payment after reasonable notice and opportunity to cure.
9. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
- OUR TOTAL LIABILITY FOR ANY CLAIMS SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM
- WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- WE ARE NOT LIABLE FOR DAMAGES RESULTING FROM THIRD-PARTY AI MODEL PROVIDERS
- WE ARE NOT LIABLE FOR THE ACCURACY, COMPLETENESS, OR RELIABILITY OF AI-GENERATED RESPONSES
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE SPECIFICALLY DISCLAIM:
- WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT
- GUARANTEES OF AI ACCURACY, COMPLETENESS, OR SUITABILITY FOR YOUR SPECIFIC NEEDS
- RESPONSIBILITY FOR THIRD-PARTY AI MODEL PERFORMANCE OR AVAILABILITY
You agree to indemnify and hold AskTuring harmless from claims arising from:
- Your use of the Service in violation of these Terms
- Content you upload or generate through the Service
- Your violation of any third-party rights
By You: You may terminate your account at any time through your account settings.
By Us: We may terminate or suspend access for Terms violations, non-payment, or discontinuation of the Service with reasonable notice.
Effect of Termination: Upon termination, your access ends, and we will delete your data according to our retention policy, except as required by law.
13. Export Control and Compliance
You acknowledge that the Service may be subject to export control laws and agree to comply with all applicable regulations regarding the export, import, or use of the Service.
14. Dispute Resolution
Governing Law: These Terms are governed by California law without regard to conflict of law principles.
Arbitration: Disputes will be resolved through binding arbitration in San Francisco, California, under the rules of the American Arbitration Association, except for claims seeking injunctive relief.
Class Action Waiver: You waive any right to pursue claims on a class action basis.
15. General Provisions
Modifications: We may update these Terms with notice through the Service or via email. Continued use constitutes acceptance of modified Terms.
Severability: If any provision is found unenforceable, the remaining provisions remain in full force.
Assignment: We may assign these Terms; you may not assign your rights without our written consent.
Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control.
16. Third-Party Services
Our Service integrates with third-party AI providers. Your use of these integrations is subject to the respective providers’ terms of service and privacy policies. We are not responsible for third-party service performance or policies.
